1. Identification of the seller
These General Terms and Conditions of Sale (hereinafter, "the Terms") govern the distance selling of products and services through the online shop of the website www.radoncanarias.com (trade name: Radón Canarias), owned by Estudios del Terreno, S.L. (hereinafter, "the seller"), with NIF B38569646, registered in the Registro Mercantil de Santa Cruz de Tenerife, and with registered address at Avenida Roma 49, 38360 El Sauzal, Santa Cruz de Tenerife (Islas Canarias, España). 2. Scope of application and acceptance
These Terms apply to all orders placed through the online shop, within the framework of the Spanish rules on distance contracts: the Real Decreto Legislativo 1/2007, de 16 de noviembre, por el que se aprueba el texto refundido de la Ley General para la Defensa de los Consumidores y Usuarios (RDL 1/2007) (Spanish General Consumer and User Protection Act), and the Ley 34/2002, de 11 de julio, de servicios de la sociedad de la información y de comercio electrónico (LSSI-CE) (Spanish E-Commerce Act). By clicking the payment button and completing the purchase, you declare that you have read, understood and fully accepted these Terms, as well as the Legal Notice and the Privacy Policy. If you do not agree with them, you must not place the order.
3. Products and included service
The online shop offers radon gas detectors of two types: Radtrak3®, for long-term measurements (approximately 90 days of exposure), and Rapid detectors, for short-term measurements. Unless expressly stated otherwise on the product page, the price of each detector includes a complete measurement service: the detector itself, the laboratory analysis and the results report.
The analysis is carried out by the ISO/IEC 17025-accredited laboratory of Radonova Laboratories AB (Sweden, European Union), to which the detectors are sent once the exposure period has ended, together with the order details required to issue the report. The processing of your personal data is described in the Privacy Policy.
4. Purchase process
The purchase is completed through the following steps:
- Selection of the products and addition to the cart, indicating the number of detectors.
- Selection of the island and municipality of delivery.
- Choice of the delivery method available for your location: technician home visit, collection at our office or postal delivery.
- If you choose collection at our office, selection of the date and time of the appointment.
- Entry of your identification, contact and, where applicable, billing details.
- Review of the order summary, with the total price itemised (products, shipping or technician service costs and IGIC, the Canary Islands general indirect tax), and secure payment via Stripe.
Before confirming the payment, you will be able to review and correct all the details of the order. Once the purchase is completed, you will receive a confirmation email with the order summary and your reference code.
In accordance with Article 27.1 of the LSSI-CE, you are further informed that the contract will be concluded in Spanish (Castilian), the only language available for its conclusion, and that the electronic document in which the contract is formalised will be filed by the seller for the periods required by tax and commercial legislation and will be accessible to you: you will receive its essential content in the confirmation email, you may consult it at any time at /tienda/consultar-pedido using your reference code and your email address, and you may request a copy by writing to radon@estudiosdelterreno.com.
5. Prices and taxes
All prices are expressed in euros (EUR) and include the Canary Islands General Indirect Tax (IGIC) at the rate of 7%, which is shown itemised in the order summary and on the invoice. The price applicable to each order is the price in force at the time of its confirmation. Obvious typographical errors in prices shall not be binding on the seller: in such cases, the customer will be offered the option of confirming the order at the correct price or cancelling it at no cost.
6. Shipping and technician service costs
Postal shipping costs and, where applicable, the price of the technician home-visit service depend on the island and zone selected, and are clearly displayed in the order summary before payment is made. The technician home-visit service is available in Tenerife, with zone-based pricing, and is free of charge above a certain number of detectors, as indicated in the shop itself during the purchase process.
7. Payment methods
Payment is made exclusively online, by credit or debit card, through the secure payment gateway of Stripe (Stripe Payments Europe Ltd). Card details are entered directly in Stripe's secure environment: the seller does not store your card details at any time. The order is deemed confirmed when Stripe notifies the authorisation of the payment.
8. Delivery and timescales
8.1. Technician home visit (Tenerife)
A technician from the seller travels to your home or workplace to place the detectors. After the purchase, we will contact you by telephone or email to arrange the date and time of the visit.
Once the measurement is complete, the collection of the detectors may need to be carried out by the customer, by handing them over to the courier service (MRW) that we will send to collect them at the agreed address, for their dispatch to the laboratory.
8.2. Collection at our office by appointment
You may collect your order at our office at C/ El Pajarito 60, Geneto, 38108 San Cristóbal de La Laguna, on the date and at the time of the appointment selected during the purchase. Appointment changes or cancellations are handled by telephone on +34 922 575 171.
8.3. Postal delivery
The order is sent by post to the address provided during the purchase. Indicative delivery times are shown during the purchase process and may vary for reasons attributable to the postal operator. If you have not received your order after a reasonable period of time, please contact us so that we can trace it or reship it.
9. Reference code and order tracking
Upon completing the purchase, you will receive a reference code in the format RC-XXXX-XXXX, included in the confirmation email. With this code and the email address used for the purchase, you may check the status of your order at any time at /tienda/consultar-pedido. We recommend that you keep the code for any matter relating to your order.
10. Invoice
We will issue an invoice for your purchase in accordance with the applicable tax legislation. If you require an invoice in the name of a company, you may provide the company name and CIF (Spanish company tax identification number) during the purchase process; the invoice will be sent by email to the address provided.
11. Returns and right of withdrawal
Returns are not accepted. The price of each detector includes a laboratory analysis service and a results report, the performance of which begins with the delivery of the detector and its exposure. By accepting these Terms and completing the purchase, you give your express consent for the performance of the service to begin within the statutory withdrawal period, and you acknowledge that, in accordance with Article 103(a) and (d) of RDL 1/2007, the right of withdrawal does not apply to this product: the detector, by its very nature, deteriorates and is rendered unusable through use, and the analysis service included is performed through the exposure and the subsequent laboratory analysis.
The foregoing does not affect the statutory warranty of conformity described in Section 12, nor the rights that consumer protection legislation grants you in the event of a defective product or a non-conforming service.
12. Statutory warranty of conformity
The detectors are covered by the statutory warranty of conformity of 3 years from delivery, in accordance with RDL 1/2007 as currently in force. In the event of a lack of conformity, you are entitled to have the goods brought into conformity by repair or replacement and, where appropriate, to a reduction of the price or termination of the contract, at no cost. The warranty covers original lacks of conformity, not the exhaustion resulting from normal use of the detector, whose function is fulfilled through exposure and subsequent analysis. To assert the warranty, please contact us through the channels indicated in Section 13, providing the order reference code.
13. Customer service
For enquiries, incidents, complaints or any matter relating to your order, you may contact our customer service department by telephone on +34 922 575 171 or by email at radon@estudiosdelterreno.com. We will deal with your complaint as promptly as possible and, in any event, within the periods laid down in consumer protection legislation.
14. Data protection
The controller of the personal data you provide during the purchase is Estudios del Terreno, S.L., which will process such data to manage your order, the delivery, the analysis service and the legal obligations arising from the sale, in accordance with Regulation (EU) 2016/679 (GDPR) and the Ley Orgánica 3/2018 (LOPDGDD) (Spanish Data Protection and Digital Rights Act). You may at any time exercise your rights of access, rectification, erasure, objection, restriction of processing and portability of your data, as well as withdraw the consent given, without affecting the lawfulness of the processing carried out beforehand, by contacting radon@estudiosdelterreno.com or by post to the address indicated in Section 1. You also have the right to lodge a complaint with the Agencia Española de Protección de Datos (Spanish Data Protection Agency) (www.aepd.es). 15. Dispute resolution
For the out-of-court resolution of consumer disputes that may arise from the purchase, you may contact the public consumer services of the Autonomous Community of the Canary Islands and the relevant municipal and island consumer information offices, and you may also request resolution of the dispute through the Sistema Arbitral de Consumo (Spanish Consumer Arbitration System). Notwithstanding the foregoing, any dispute arising from the interpretation or performance of these Terms shall fall within the jurisdiction of the courts and tribunals of the consumer's place of residence, in accordance with the applicable consumer protection legislation.
16. Severability and applicable law
If any clause of these Terms is declared null and void or unenforceable, in whole or in part, such nullity shall not affect the remaining clauses, which shall retain their full validity and effect. These Terms are governed by Spanish law and, in particular, by RDL 1/2007 and LSSI-CE 34/2002; in matters of data protection, Regulation (EU) 2016/679 (GDPR) and the Ley Orgánica 3/2018 (LOPDGDD) apply.
